Things to know about employment visas

On Behalf of | Oct 29, 2024 | Employment Immigration

Employment visas allow skilled workers to come into the United States under the sponsorship of a business in this country. There are various visa categories that fall under the employment visa umbrella. Each of these has specific terms for job type, duration of employment and skill level.

Anyone who’s considering using an employment visa to come into the U.S. or to remain here should ensure they understand the terms for their specific visa.

Certain employment visas have limits

Some employment visas, including the H-1B visa, have an annual cap regarding the number that will be issued. In the case of the H-1B visa, there’s a lottery system that’s used when the demand exceeds the maximum number that can be issued. There are other types of employment visas, such as EB-1, EB2, EB3, EB4 and EB5, that are also available.

Employers must meet specific requirements

Employers can’t just decide that they’re going to sponsor someone. Instead, they have to ensure the company and the job posting meet specific requirements. The Department of Labor issues these regulations, which include paying a fair wage and using a fully accurate job description.

The process for obtaining an employment visa starts long before the employee is hired or starts with the company. These employment visas are a wonderful opportunity for companies to bring in high-quality talent, and they give employees the opportunity to come to the United States.

It’s critical for all employers and potential employees to understand their responsibilities and rights throughout the process. Working with someone who’s familiar with immigration policies may be beneficial for everyone involved.
