The H-1B visa is one of the most popular employment visas. Every year, the United States Citizenship and Immigration Services (USCIS) can issue up to 85,000 total H-1B visas. 

Most years, the USCIS receives far more applications than the total number of visas available. To ensure fairness when awarding those visas, the USCIS has historically used a randomized lottery system for determining who secures a visa. 

As of the March 2026 H-1B visa lottery, the system has changed significantly. Both employers and skilled workers need to understand the new, less random lottery system. 

Wages and skills now influence the odds of success

Historically, the H-1B lottery has been as neutral and random as possible. Every applicant had roughly the same odds of approval based on the total number of people seeking H-1B visas. 

However, this approach has led to concerns about abuses of the program. Fears about employers hiring international workers to reduce the salaries paid for competitive positions inspired changes to the lottery system. 

Currently, applicants receive weighted consideration based on how competitive their compensation package is and the skills they can provide their employers. Higher-paid professionals and those with unique training receive priority consideration under the new weighted system for the H-1B lottery. In cases where companies offer questionable compensation, the applicants they sponsor may be less likely to secure a visa than those offered wages that mirror what domestic professionals receive.
